What is conveyancing?
Conveyancing is the legal process of transferring the ownership of a property from one person to another. It involves various tasks such as property searches, preparing and reviewing legal documents, and exchanging contracts between the parties involved in the transaction.
Here are some of the things that a conveyancer typically does:
- Reviewing the contract of sale: A conveyancer will review the contract of sale and advise you on any potential issues or concerns.
- Conducting property searches: A conveyancer will conduct searches to ensure there are no outstanding issues with the property or land, such as zoning restrictions, unpaid rates or charges, or any other legal issues that may affect the transaction.
- Liaising with the other party's conveyancer: A conveyancer will communicate with the other party's conveyancer to ensure that the transaction progresses smoothly.
- Preparing legal documents: A conveyancer will prepare and review all legal documents required for the sale or purchase of the property, including transfer documents, mortgage documents, and any other legal agreements.
- Managing financial aspects: A conveyancer will manage the financial aspects of the transaction, including the deposit, stamp duty, and settlement.
- Conducting property settlements: A conveyancer will attend the settlement to ensure that all legal and financial requirements have been met, and that the property has been transferred correctly.
- Providing legal advice: A conveyancer will provide legal advice on any legal issues or disputes that may arise during the transaction.
